Version 2, effective 2026-10-07
Terms of Service
These terms are an agreement between you and BREATHINGROOM.IO LLC, trading as Breathing Room ("we", "us"), about your use of the Breathing Room service at breathingroom.io and the Breathing Room Android app (together, the "Service"). By creating an account you accept these terms and our Privacy Policy. If you do not agree, do not use the Service.
1. Who may use the Service
You must be at least 18 years old and able to enter into a binding contract to create an account. The Service is for individuals: your own therapy data, or the data of a family member or dependant you are entitled to act for. It is not for clinics, healthcare providers or equipment suppliers handling patients' data in a professional capacity, and we do not enter into business-associate or data-processing agreements for that use.
The Service is operated from the United States. It is not offered to residents of the European Economic Area, the United Kingdom or Switzerland, and you may not create an account if you live there.
2. What the Service is, and is not
Breathing Room reads the data card from a CPAP or bilevel device, stores a copy, and shows you charts, statistics, trends, a printable report and, optionally, AI-generated summaries.
The Service is not medical advice, diagnosis or treatment. It is a self-tracking tool for information only. It is not a medical device and has not been reviewed, cleared or approved by the FDA or any other health regulator. Using it does not make us your clinician, and nothing shown by the Service replaces the judgement of yours. We are not a healthcare provider, and we are not a covered entity or business associate under HIPAA. Do not change your therapy settings or stop therapy because of anything you see here without talking to the person who prescribes your treatment. AI-generated text can be wrong, incomplete or misleading; check it against your own data and your clinician. If you think you are having a medical emergency, call your local emergency number.
3. Your account
- You are responsible for keeping your sign-in methods (password, sign-in links, passkeys, connected Google account, two-factor codes and recovery codes) private.
- You must give us a working email address; we use it to sign you in and to tell you about your account.
- One person per account. You may not share an account or transfer it to someone else.
- You may not use the Service to store data you have no right to hold, to probe or disrupt the Service, to reverse-engineer it, or for anything unlawful.
4. Free accounts, Premium and payment
- Every account is free. A free account can upload and see the nights from the last 30 days. Older nights are kept while your account exists, never deleted for being old, and open again with a Premium subscription. Premium also includes Trends, PDF reports, CSV and JSON exports, the API, sleep-tracker and oximeter overlays and AI summaries.
- Every new account starts with a Premium trial of the length shown when you sign up. When the trial ends, the account is a free account.
- Subscriptions are monthly or yearly, billed in advance at the price shown in the app, and renew automatically until cancelled.
- Payments are processed by Stripe, Inc. with Stripe acting as the merchant of record through its Link and Managed Payments service. Stripe collects and remits any applicable sales tax or VAT and issues your receipts. You will see Stripe's name on your statement.
- You can cancel at any time from Settings → Billing; access continues until the end of the paid period and no further payments are taken.
- Refunds: because Stripe is the merchant of record, refund requests are handled under Stripe's Link consumer terms, which may allow a refund within 60 days of a charge. Outside that policy, subscription fees are non-refundable, including for partly used periods.
- If a payment fails we will try again for a few days and tell you by email; if it keeps failing the subscription is cancelled and the account is a free account.
- We may change prices for future renewal periods with at least 30 days' notice by email.
5. Your data
- Your uploaded files and everything derived from them remain yours. You give us permission to store, process and display them to you, and to send them to the processors named in the Privacy Policy, only so we can provide the Service.
- You can download your account data at any time from Settings → Data & devices; the night-level exports are part of Premium. The download does not include the raw device files themselves; the originals on your card stay with you.
- Share links you create let anyone holding the link read your data until the link expires or you revoke it. You are responsible for who you send them to.
- AI summaries and answers are produced by sending a numeric digest of your nights, your journal ratings and tags and your question to the AI provider named in the Privacy Policy. You choose whether to use this feature.
6. Deleting your account
You can delete your account from Settings → Account. The account is disabled immediately, any subscription is cancelled immediately without a refund, and everything you uploaded is permanently deleted after a 14-day grace period. During those 14 days you can sign in and restore the account; a cancelled subscription is not restored. We may also delete an account that has never subscribed and has not been used for 60 days after its trial ended: we email you a warning, and delete the account if it is still unused 30 days later.
7. Availability, changes and no warranty
We aim for high availability but do not guarantee it, and we may change or remove features. Keep your own copies of anything important: the data card is yours and the Service is not a backup.
The Service is provided "as is" and "as available", without any warranty, express or implied. To the fullest extent the law allows, we disclaim the implied warranties of merchantability, fitness for a particular purpose and non-infringement, and we do not promise that the Service will be uninterrupted or error-free or that what it shows you is accurate or complete.
8. Liability
To the fullest extent the law allows, we are not liable for indirect, incidental or consequential loss, for any decision you or anyone else makes based on what the Service shows, or for loss of data. Our total liability to you for any claim is limited to the amount you paid us in the 12 months before the claim. Nothing in these terms limits liability that cannot be limited by law.
9. Ending the agreement
You may end it by deleting your account. We may suspend or end an account that breaks these terms, after telling you why unless the law prevents it.
10. Changes to these terms
We may update these terms and the Privacy Policy. When a change matters, we will ask you to read and accept the new version the next time you sign in; until you do, you can still read your data, download it or delete your account, but not add to it. The version number and effective date at the top of this page tell you which version applies.
11. Governing law
These terms are governed by the laws of the State of New Jersey, USA, and any dispute will be heard by the state or federal courts located in Essex County, New Jersey, unless the law where you live gives you rights that cannot be taken away.
